Welcome back!!! Let the Law learning begin....
September 6/7...Students learned about Common Law (and how precedent works). At the same time, students learned a little about aboriginal governance (using consensus as a means to govern) while they were discussing the Rule of Law...Critical thinking, communication, social competencies were clearly demonstrated! Apply/use these concepts for the rest of the year!
September 8...Rule of Law continued....the task for the day is on the notes that follow:

This is an introduction to Criminal Law and how wrongful convictions can and do occur when our system fails...in 1959 (when this case began) the Canadian Charter did not exist. Today, the individual rights afforded to our citizens, may have prevented the problems Mr. Truscott faced at arrest, and trial.

Dec. 7...notes for chapter 4 are almost complete...Agenda 7 is available...R. Oakes (1986)... Unit tests are scheduled for Dec. 14/15. Students who miss the test will need to write ASAP...after Dec. 22 all re-writes for the Chapter 4 test will be scheduled for the June ""I" Day! Dogs bark, but the caravan moves on...

Dec. 21/22...State vs. Rodney Reed....What factors can lead to the arrest and conviction of innocent people? The Reed case began in 1995 with the murder of a 19 year old woman. Mr. Reed became a suspect and the police zeroed in on him...evidence and witnesses were evaluated...the jury found Mr. Reed guilty and sentenced him to death. In October 2017 a judge listened to new evidence that may set Mr. Reed free! Students watched the documentary about this case and what appears to have been a "miscarriage of justice" for the accused...why did it happen? Could this happen in Canada?

May 7-10...Unintentional Negligence...students were asked to review a case and determine who owed who a duty of care...who might have a civil case, and what damages might be requested.

May 28-June 1...Negligence and Tort Law...who could have sued when the Titanic sank in 1912??? Would there have been a Third Party Claim? Did passengers sign a waiver? Was there presence a case of voluntary assumption of risk> Did they contribute to their own deaths?After a brief review, students were asked to read the case brief for Crocker v. Sundance and answer the questions...some students watched a real time digital video of the Titanic sinking. Please hand in the Teno case

It's time to complete the Civil Law Final! Students are expected to create a civil case and file a Notice of Claim. In addition, students must submit a written report outlining the case, the defendant (s), the plaintiff, the damages requested, and possible defences to the tort (s).
